Agreement to Terms
By downloading, installing, or using OBD2assistant ("the App"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the App.
Description of Service
OBD2assistant is a mobile application that connects to an OBD2 adapter to read and interpret vehicle diagnostic data. The App provides information about vehicle health, diagnostic trouble codes, and performance metrics, along with AI-powered analysis and recommendations.
Use at Your Own Risk
The App is designed to provide informational insights about your vehicle. However, you acknowledge and agree that:
- Use of the App is entirely at your own risk
- The App is not a substitute for professional vehicle inspection or maintenance
- You should always follow your vehicle manufacturer's guidelines for maintenance and repair
- The App's analysis and recommendations are advisory in nature and should be verified by qualified professionals before taking action
Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not guarantee that:
- The App will always function without disruptions, delays, or imperfections
- The information provided will be error-free or completely accurate
- The App will be compatible with all vehicles or OBD2 adapters
- Any defects or errors will be corrected
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL DAMAGES, OR ANY DAMAGES WHATSOEVER INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF USE, DATA, OR PROFITS, ARISING OUT OF OR IN ANY WAY CONNECTED WITH THE USE OR PERFORMANCE OF THE APP.
This includes, but is not limited to:
- Damage to your vehicle
- Costs of vehicle repair or maintenance
- Personal injury
- Any other damages resulting from decisions made based on information provided by the App
User Responsibilities
By using the App, you agree to:
- Use the App in compliance with all applicable laws and regulations
- Not use the App while operating a vehicle or in any way that creates a safety hazard
- Not attempt to reverse engineer, modify, or create derivative works from the App
- Not use the App to infringe upon the rights of others
- Accept responsibility for all activities that occur through your use of the App
Data Usage and Privacy
Your use of the App is also governed by our Privacy Policy, which is incorporated by reference into these Terms of Service. Please review our Privacy Policy to understand how we collect, use, and protect your information.
License and Intellectual Property
The App and all of its content, features, and functionality are owned by us and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial use in accordance with these Terms of Service.
Changes to Terms
We reserve the right to modify these Terms of Service at any time. We will provide notice of significant changes by updating the "Last Updated" date at the top of these terms. Your continued use of the App after such changes constitutes your acceptance of the new terms.
Termination
We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms of Service.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of New Zealand, without regard to its conflict of law provisions.
