Critical Safety Notice
OBDAssistant is a vehicle intelligence and diagnostic information tool. It is NOT a substitute for professional mechanical advice, inspection, or repair. Use of the app is at your own risk. Always consult a certified technician for safety-critical systems including brakes, steering, airbags, suspension, and engine management.
1. Acceptance of Terms
By downloading, installing, or using the OBDAssistant mobile application, website (obd2assistant.com), or any associated services, you agree to be bound by these Terms & Conditions. These terms constitute a legal agreement between you and Mellers Tech Limited, a company registered in New Zealand ("we", "us", "our"). If you do not agree, you must stop using all OBDAssistant products immediately.
2. Service Description & Licence
OBDAssistant grants you a limited, non-exclusive, non-transferable, revocable licence to use our vehicle intelligence platform for personal, non-commercial use. The service provides:
- OBD-II diagnostic scanning (DTC reading, clearing, freeze frame, live data, VIN/ECU identification)
- AI-powered diagnostic analysis and guidance
- Performance testing (brake test, dyno/HP/torque estimation, 0–100 timing, quarter-mile, suspension test)
- Background health monitoring (Sentinel)
- Diagnostic report generation
- Community forum participation
- Regional Health Index data visualisation
3. Core OBD Diagnostics
OBDAssistant reads and interprets data from your vehicle's OBD-II port. You acknowledge and agree that:
- OBD-II data may be incomplete, inaccurate, or unavailable depending on your vehicle, adapter, and connection quality.
- Cheap, clone, or counterfeit ELM327 adapters may produce unreliable data, fail to connect, or cause communication errors.
- Not all vehicles support all OBD-II PIDs or protocols. Manufacturer-specific limitations apply.
- DTC scanning does not guarantee detection of all faults. Some faults may not trigger codes.
- Generated reports are informational summaries only — they are not certified inspection reports, WOF certificates, insurance reports, emissions compliance documents, valuation reports, or manufacturer diagnostic reports.
- Clearing diagnostic trouble codes does not fix the underlying fault. Clearing codes erases diagnostic evidence and may reset emissions readiness monitors, potentially causing WOF/inspection failure.
4. AI Diagnostic Assistant
The AI diagnostic assistant provides informational guidance based on vehicle data analysis. You acknowledge that:
- AI guidance is informational only and may be incomplete, inaccurate, or contextually inappropriate.
- AI analysis does not replace a qualified mechanic, WOF inspection, manufacturer diagnostic process, or professional safety inspection.
- Vehicle diagnostic data (DTCs, sensor readings, vehicle profile, scan history, live data snapshots) may be processed by external AI service providers (such as Google Gemini, OpenAI, or Groq) to generate insights.
- You should always verify AI suggestions with a qualified professional before acting on them.
5. Vehicle Safety
You agree to the following safety obligations:
- Do not use OBDAssistant while driving or operating a vehicle.
- Do not ignore dashboard warning lights based on app readings.
- Do not clear diagnostic codes without understanding the underlying cause.
- Clearing codes does not fix faults and may erase important diagnostic evidence or reset emissions readiness monitors.
- Safety-critical faults involving brakes, steering, airbags, overheating, charging system, emissions, or drivability require immediate professional inspection regardless of what the app displays.
6. Brake Test
The brake test feature uses your phone's accelerometer and gyroscope sensors. You acknowledge that:
- Results are informational only and are not a certified brake test, WOF result, roadworthiness assessment, or compliance inspection.
- Accuracy depends on phone mounting position, sensor calibration, road surface, tyre condition, ABS operation, weather, road gradient, and phone sensor quality.
- You must only perform brake tests where it is safe and legal to do so.
- Never rely solely on brake test results to assess brake safety. Always have brakes inspected by a qualified mechanic.
7. Dyno / Performance Tests
The dyno mode, horsepower/torque estimation, 0–100 timing, and quarter-mile features provide estimated results only. You acknowledge that:
- Results are not chassis-dyno certified and should not be compared directly to professional dynamometer readings.
- Accuracy is affected by GPS/sensor quality, estimated vehicle weight, road gradient, wind, tyre condition, drivetrain loss assumptions, phone sensor calibration, and phone placement.
- You must obey all road laws and only perform performance tests in safe, legal environments (e.g., closed courses, private roads with permission, or designated testing facilities).
- We accept no liability for traffic violations, accidents, or damage arising from performance testing.
8. Suspension Test
The suspension test feature uses phone sensors to assess suspension behaviour. Results are indicative only and are not:
- A certified suspension inspection
- A WOF or roadworthiness result
- A substitute for professional workshop suspension testing
Accuracy depends on phone mounting, road surface, speed, tyre pressure, suspension type (passive, adaptive, air), and sensor quality.
9. Sentinel / Background Health Monitoring
The Sentinel feature performs background vehicle health checks via Bluetooth/OBD reconnection. You acknowledge that:
- Sentinel may fail to reconnect, miss alerts, or produce false positives or false negatives.
- Push notifications are not emergency warnings and do not constitute guaranteed vehicle monitoring.
- Battery/alternator health insights, baseline comparisons, and health scores are informational estimates only.
- You remain solely responsible for maintaining your vehicle regardless of Sentinel notifications.
10. Subscriptions & Billing
10.1 Premium Plans
Certain features require a paid subscription (Pro Weekly, Pro Monthly, Pro Annual, 24h Pass, or Lifetime unlock if offered). All billing is processed through Google Play Billing.
10.2 Free Trials
New users may be eligible for a free trial. Unless cancelled at least 24 hours before the trial ends, the subscription will automatically convert to a paid plan.
10.3 AI Usage Limits
AI diagnostic features may be subject to fair-use limits depending on your subscription tier. Excessive automated or scripted usage may result in temporary throttling.
10.4 Cancellation
You can cancel your subscription at any time through your Google Play Store subscription settings. Cancellation takes effect at the end of the current billing period.
10.5 Refunds
Refunds are subject to Google Play Store refund policies and applicable consumer protection law (including the New Zealand Consumer Guarantees Act where applicable).
10.6 Entitlement Restoration
If you reinstall the app or sign in on a new device, your subscription entitlements will be restored automatically through Google Play Billing.
11. Community Forum
By participating in the OBDAssistant community forum, you agree to our Community Guidelines. You are solely responsible for content you post and for any advice you follow from other users.
12. Intellectual Property
All content, including the AI engine logic, UI design, brand assets, and diagnostic algorithms, are the exclusive property of Mellers Tech Limited. You may not reverse engineer, decompile, or attempt to extract the source code of the application.
13. Limitation of Liability
To the maximum extent permitted by law (including the New Zealand Consumer Guarantees Act and Fair Trading Act where applicable), Mellers Tech Limited and its developers shall not be liable for any direct, indirect, incidental, or consequential damages, including but not limited to:
- Mechanical damage to any vehicle
- Safety system failures or accidents
- Personal injury or property damage
- Inaccurate diagnostic data, AI insights, or test results
- Missed alerts or false notifications from Sentinel
- Decisions made based on app data without professional verification
- Data loss or service interruptions
14. Governing Law & Dispute Resolution
These Terms are governed by the laws of New Zealand. Any disputes shall be resolved through the courts of New Zealand, or through binding arbitration in Auckland, New Zealand, at our election.
15. Changes to Terms
We reserve the right to update these terms at any time. The "Last updated" date reflects the most recent revision. Continued use after changes are posted constitutes acceptance.
